1. Acceptance of Terms

By accessing or using FindMySublet (“the Platform”), operated by FindMySublet, Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify you of material changes via email or a prominent notice on the Platform.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use FindMySublet. By creating an account, you represent and warrant that you meet these requirements.

3. Account Registration

You may register using an email address and password, or through Google single sign-on. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate, current, and complete information during registration and to update it as necessary. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. No Broker, No Agency Relationship

FindMySublet is a technology platform that allows users to post and discover short-term rental and sublet listings. We are not a real estate broker, agent, property manager, landlord, or any other kind of real estate intermediary, and nothing on the Platform constitutes real estate, legal, or financial advice.

No agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship is created between FindMySublet and any user by virtue of these Terms or use of the Platform. Any rental or subletting agreement is a direct, private contract solely between the poster and the renter. FindMySublet is not a party to, and accepts no liability for, any such agreement.

We do notverify that a poster owns the property, holds a valid lease, or has obtained any required consent from a landlord or property manager unless expressly and prominently stated in a verified badge description. Verification badges (e.g., “Student Verified”) relate only to the identity check described in Section 5 and do not constitute an endorsement of the listing, the poster’s legal authority to sublet, or the accuracy of any listing content.

5. Verification

FindMySublet offers optional verification features to build trust between users:

  • Email verification — confirming your account email address.
  • Phone verification — confirming your phone number via SMS one-time code.
  • University email verification — confirming a .edu email address for Student Verified status.

Verification badges indicate that a user has completed these steps at the time of verification. They do not constitute a background check, criminal records check, credit check, identity guarantee, or endorsement by FindMySublet.

6. Sublet Legality & Lease Compliance

If you post a sublet or short-term rental listing, you are solely responsible for ensuring your listing and any resulting rental arrangement comply with all applicable laws and agreements, including but not limited to:

  • Landlord consent: Obtaining written or other required permission from your landlord or property owner to sublet or rent out the property.
  • Lease terms: Confirming your lease does not prohibit subletting or short-term rentals.
  • Building and HOA rules: Complying with any condominium, homeowners’ association, dormitory, or building policies regarding occupancy and subletting.
  • Local and state law: Complying with all local ordinances, zoning regulations, housing codes, and short-term rental licensing or registration requirements.
  • Occupancy limits: Not exceeding legally permitted occupancy for the property.

FindMySublet does not review, approve, or confirm the legal authority of any poster to sublet a listed property. We expressly disclaim any liability for listings posted without proper authorization or in violation of any law or agreement. Posters who list properties without proper authority may be subject to account suspension and may bear legal liability to their landlord, tenants, or local authorities entirely on their own.

7. Fair Housing Compliance

FindMySublet is committed to fair housing principles. The Platform may not be used to publish, facilitate, or otherwise enable any discriminatory housing practice. You agree not to post any listing, profile content, or message that discriminates against or expresses any preference, limitation, or exclusion based on:

  • Race, color, or national origin
  • Religion or creed
  • Sex, gender identity, or sexual orientation
  • Familial status (including pregnancy or having children)
  • Disability or handicap
  • Age
  • Any other characteristic protected by the Fair Housing Act, applicable state law, or local ordinance

FindMySublet reserves the right to immediately remove any listing or content that appears to express discriminatory preferences and to suspend or permanently ban accounts that engage in discriminatory conduct. If you believe a listing or message violates fair housing principles, please use the “Report this listing” feature or contact us at support@findmysublet.com.

8. Listings & Content

Posters represent and warrant that:

  • They have the legal right to sublet, rent, or offer the property as described in Section 6.
  • All listing information (photos, descriptions, pricing, availability) is accurate and not misleading.
  • The property complies with all applicable local, state, and federal laws, including housing and fair housing regulations.
  • Photos and other content they upload do not infringe on any third-party copyright, trademark, or other intellectual property rights.

Rentersare responsible for independently verifying all listing information — including the poster’s authority to sublet, the accuracy of the listing, and the suitability of the property — before entering into any rental agreement, paying any deposit, or moving in.

All listings are subject to review. We reserve the right to remove, modify, or reject any listing at our sole discretion, including listings that appear fraudulent, misleading, discriminatory, or in violation of these Terms.

9. Scams, Fraud & Off-Platform Payments

FindMySublet does not process, hold, or facilitate any payments. We are not an escrow service, payment processor, or financial intermediary of any kind. All financial transactions — including deposits, rent, and fees — occur entirely outside the Platform, directly between the poster and renter.

Warning: Rental scams are common. Please exercise extreme caution.

  • Never wire money, send cryptocurrency, or use gift cards to pay a deposit or rent before meeting the poster in person and physically verifying access to the property.
  • Never send money to anyone you have not met in person and whose identity you have not independently confirmed.
  • Legitimate posters will not pressure you to pay immediately or ask you to move transactions off the Platform.
  • Be suspicious of listings with unusually low prices, vague descriptions, or requests for payment before viewing.
  • FindMySublet strongly recommends using a written sublease agreement reviewed by a legal professional before any money changes hands.

FindMySublet is not responsible for financial losses arising from fraudulent listings or off-platform payment arrangements.If you suspect a listing is fraudulent, report it immediately using the “Report this listing” feature and contact local law enforcement.

10. Messaging & Communication

FindMySublet provides an in-platform messaging system for renters and posters to communicate. Messages are stored on our servers and are subject to our Privacy Policy.

You agree to use the messaging system only for legitimate inquiries related to listings on the Platform. You agree not to send spam, solicit personal financial information, or engage in harassing, threatening, or fraudulent communications.

Emergency notice: The FindMySublet messaging system is not a safety or emergency service. Do not use the Platform to report emergencies, threats, or immediate safety concerns. In an emergency, contact your local emergency services (e.g., 911 in the U.S.) immediately.

11. Payments, Fees & Future Monetization

Listing on FindMySublet is currently free of charge. We reserve the right to introduce fees for premium features, boosted listings, or other paid services in the future.

If and when paid features are introduced, they will be governed by additional pricing, billing, renewal, cancellation, and refund terms, which will be presented to you at the time of purchase and incorporated into these Terms by reference. We will provide advance notice of any new fees before they take effect. You will not be charged for any feature without your affirmative consent.

All current and future pricing is displayed in U.S. dollars. We are not responsible for any foreign transaction fees, currency conversion fees, or taxes imposed by your payment provider or government.

12. Map, Address & Content Accuracy

Address suggestions, map pins, neighborhood labels, and geocoded data on the Platform are generated using third-party geocoding services (including OpenStreetMap Nominatim) and are provided for informational and convenience purposes only. They may be approximate, outdated, or incorrect.

You should not rely on geocoded locations, neighborhood designations, or map data as authoritative. Always independently verify a property’s exact address, location, proximity to points of interest, transit options, commute times, and neighborhood characteristics before making any housing decision. FindMySublet disclaims all liability for any inaccuracies in geocoded data, map information, or address suggestions.

Listing content — including descriptions, photos, pricing, amenity lists, and availability dates — is provided entirely by the posting user and is not verified by FindMySublet. We make no representations about the accuracy, completeness, or timeliness of any listing.

13. Intellectual Property & DMCA

All content, branding, design, and software on FindMySublet is owned by FindMySublet, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

By posting content (photos, descriptions, etc.) on the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely in connection with operating and promoting the Platform. You retain ownership of your content and represent that you own or have the necessary rights to the content you post.

DMCA Copyright Complaint Procedure

If you believe that content on the Platform infringes your copyright, you may submit a notice pursuant to the Digital Millennium Copyright Act (DMCA) by emailing support@findmysublet.comwith the subject line “DMCA Takedown Request” and including all of the following:

  • A physical or electronic signature of the copyright owner or authorized agent.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the allegedly infringing content, including its URL on the Platform.
  • Your name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

We will review valid DMCA notices and take appropriate action, which may include removing the infringing content and notifying the user who posted it. Repeat infringers may have their accounts terminated.

14. Prohibited Conduct

You agree not to:

  • Post false, fraudulent, or misleading listings or information.
  • Post listings for properties you do not have the legal right to sublet or rent.
  • Impersonate another person or entity.
  • Harass, threaten, or abuse other users through the messaging system or any other means.
  • Publish content that discriminates based on any protected characteristic as described in Section 7.
  • Scrape, crawl, or use automated tools to collect data from the Platform without our written consent.
  • Attempt to circumvent security features, authentication, or access controls.
  • Use the Platform for any unlawful purpose, including housing discrimination or rental fraud.
  • Upload content that is obscene, defamatory, or infringes on third-party intellectual property rights.
  • Send unsolicited commercial messages (spam) through the messaging system.
  • List properties located in jurisdictions where short-term rentals or subletting is prohibited without proper licensing.

15. Reporting, Trust & Safety

Users may report listings they believe violate these Terms using the “Report this listing” feature. Our team reviews every report and may take action including removing listings, warning users, suspending accounts, or permanently banning users.

We are not obligated to monitor all content at all times but reserve the right to do so. Reports submitted in bad faith or as a means of harassment may result in action against the reporting user.

Evidence preservation: In connection with fraud investigations, abuse investigations, safety incidents, content moderation decisions, legal holds, or credible legal claims, we expressly reserve the right to preserve and retain user data — including listings, messages, reports, IP addresses, device metadata, account activity logs, and investigation records — for as long as reasonably necessary to resolve the matter, fulfill legal obligations, protect the rights and safety of other users, or comply with applicable law. This retention right supersedes any user-initiated deletion request for the affected records.

16. Account Suspension & Bans

We reserve the right to suspend, restrict, or permanently terminate any user account at any time, with or without notice, if we reasonably believe the account has been used to:

  • Violate any provision of these Terms.
  • Engage in fraud, scams, or misrepresentation.
  • Violate fair housing laws or post discriminatory content.
  • Cause harm, distress, or financial loss to other users.
  • Post listings without legal authority to do so.
  • Compromise the security, integrity, or reputation of the Platform.

Banned users may not create new accounts. Upon termination for cause, any content posted by the banned user may be removed at our discretion. We are not liable for any losses a user may suffer as a result of account suspension or termination.

17. Limitation of Liability

FindMySublet is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or reliability of any listing, user profile, verification badge, geocoded data, or communication on the Platform.

To the fullest extent permitted by law, FindMySublet, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to losses related to rental transactions, property damage, personal injury, fraudulent listings, or reliance on any geocoded or map data.

Our total aggregate liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the greater of (a) the total fees you paid to FindMySublet in the twelve months preceding the claim, or (b) USD $100.

18. Indemnification

You agree to indemnify, defend, and hold harmless FindMySublet, Inc. from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your content, your violation of these Terms, your violation of any applicable law (including housing, rental, or subletting laws), or your violation of any third-party rights.

19. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform that cannot be resolved informally shall be submitted to binding arbitration administered by a nationally recognized arbitration provider (such as JAMS or AAA) under its applicable rules. The arbitration shall be conducted on an individual basis; you waive any right to bring or participate in any class action, class arbitration, or representative proceedingagainst FindMySublet. The arbitration shall take place in Delaware unless you and we agree otherwise or the arbitration provider’s rules require otherwise.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction for the protection of intellectual property or confidential information. Nothing in this section limits our right to pursue claims in small claims court where eligible.
